1. Product Information and Availability
Swiss Stone Masons takes great care in providing accurate descriptions and images of all products, including tombstones, granite, and marble. However, natural variations in materials may cause slight discrepancies in colour and texture. All products are subject to availability, and Swiss Stone Masons reserves the right to discontinue or modify product offerings without notice.
2. Orders and Payment Terms
When placing an order with Swiss Stone Masons, whether for tombstones, custom monuments, or granite products, all orders are final upon confirmation. Prices are subject to change, but confirmed orders will honour the price at the time of purchase. Payment must be made in accordance with the agreed terms, which may include full upfront payments or instalment plans. Any unpaid amounts beyond the agreed terms may result in delays or cancellations of service.
3. Lay-by and Cancellation Policy
Swiss Stone Masons offers a flexible lay-by plan, allowing customers to reserve products with gradual payments. Lay-by orders must be completed within the specified time, typically up to three years. If a lay-by order is not paid in full within this period, it will be automatically cancelled without any refund. Cancellations are not permitted once an order is placed, and all confirmed purchases are considered final and binding.
4. Maintenance Services for Graves
Swiss Stone Masons provides a comprehensive grave maintenance service under a monthly contract. This service includes two visits per month for grass cutting, cleaning, monument washing, repainting of inscriptions, and ground levelling. For gravesites still within the 5-year guarantee period, services will begin immediately after contract signing. For older gravesites, a pre-service inspection will be conducted to assess any damages, and necessary repairs will be quoted separately. Maintenance contracts are available for local municipality cemeteries only, and clients will receive regular reports, including before-and-after photographs, documenting each service visit.
5. Product and Service Guarantees
Swiss Stone Masons stands by the quality of its products and services. A 5-year guarantee is provided for all newly erected monuments, covering structural integrity and craftsmanship. Any issues arising within this period will be addressed by Swiss Stone Masons at no additional cost. For older gravesites and monuments, Swiss Stone Masons offer inspection and repair services at the client's expense, with guarantees applied on a case-by-case basis.
6. Liability and Limitations
Swiss Stone Masons is not liable for any damages or losses resulting from improper use or installation of its products. Furthermore, Swiss Stone Masons cannot be held responsible for any issues arising from external factors such as environmental conditions, weather, or neglect. Any damages occurring outside of the 5-year guarantee period are the responsibility of the client. For maintenance contracts, clients must report any observed damages or irregularities in a timely manner.
7. Payment Methods and Debit Orders
Swiss Stone Masons accepts a variety of payment methods, including debit orders. Clients who choose to pay for maintenance services via monthly debit orders are required to sign a contract authorising automatic payments. Failure to honour debit orders may result in the suspension of services until payment is made. Any additional fees or penalties associated with failed payments will be the responsibility of the client.
8. Surety and Dispute Management
As part of its commitment to secure transactions, Swiss Stone Masons works with trusted service providers to handle payments, including debit orders. Clients are required to ensure that all mandates for debit orders and other payments are properly documented and retained for a minimum of five years. This is particularly important in cases where disputes may arise after payments are completed. The surety, as outlined in Annexure A of the relevant agreements, is a risk deposit retained for dispute resolution, covering any unpaid or disputed transactions even after the service period has ended.
9. Privacy and Data Protection
Swiss Stone Masons is committed to protecting the privacy of its customers. Personal information collected during transactions, including names, contact details, and payment information, will be stored securely and used only for the purposes of processing orders and providing services. Swiss Stone Masons complies with all applicable data protection laws and will never share customer information with third parties without explicit consent.
10. Modifications to the Terms of Service
Swiss Stone Masons reserves the right to modify these Terms of Service at any time. Any changes will be posted on the website, and it is the client's responsibility to review the terms periodically. Continued use of the website or services after any changes are posted constitutes acceptance of the modified terms.
